Unified Payments Group LLC (“Unified Payments Group,” “we”, “our”, or “us”) offers payment gateway services that enable businesses and merchants (each, a “Merchant”) to accept payments from you.

This Privacy Policy describes the types of Personal Information we collect through our payment gateway (our “Services”). This Privacy Policy describes how we use Personal Information, and with whom we share Personal Information. This Privacy Policy applies to Personal Information that you may provide to us or that we gather or collect via or in connection with the Services. It does not apply to any Personal Information collected by third party websites or services not operated by us. For purposes of this Privacy Policy, “you” includes yourself as an individual, the entity on whose behalf you are acting and such entity’s beneficial owners if identified to us.

By accessing or using our Services, on behalf of you, as an individual, and the entity and its beneficial owners, consent to the terms of this Privacy Policy and our collection, use, storage and disclosure of Personal Information as set forth herein. You represent and warrant that you have all necessary consents and authorizations from the entity on whose behalf you are acting and its beneficial owners to provide us with, and authorize our collection of, Personal Information and to enter into this Privacy Policy on their behalf.

 

Personal Information We Collect

“Personal Information” is any information that relates to an identified or identifiable individual or you, including your proprietors and owners. We collect the following Personal Information: your full name, email address, address, phone number, payment information (e.g., credit or debit card number, or bank account information), and/or transaction information (e.g., purchase amount, date of purchase, payment method, transaction history, purchase history and order information, time stamps related to your order, transaction and payment, delivery information and billing or shipping address). We may receive this information directly from you or from third parties, including Merchants. You authorize each Merchant to share and disclose to us Personal Information it may retain or otherwise have access to about you.

In the event we conduct any activities to detect and resolve any fraud or security concerns, we will receive Personal Information from third parties, including, but not limited to third-party verification services, credit bureaus, financial institutions, mailing list providers, and publicly available sources, as necessary to confirm your identity and prevent fraud or address any security concern.

We, and our third-party partners, collect certain Personal Information automatically when you visit or use our Services. This information is typically collected through a variety of tracking technologies, including cookies, web beacons, embedded scripts, location-identifying technologies, file information, and other technology (collectively, “Tracking Technologies”). We, and our third-party partners, use these Tracking Technologies and other tools to automatically collect usage and device information, such as your IP address, location, browser type, Internet service provider, platform type, device type, operating system, date and time stamp, a unique ID that allows us to uniquely identify your browser, mobile device or your account, your internet service provider, and other such information. We also collect information about the way you use or access our Services, for example, the site from which you came and the site to which you are going when you leave our website, the pages you visit, the links you click, how frequently you access the Services, whether you open e-mails or click the links contained in e-mails, whether you access the Services from multiple devices, and other actions you take on the Services.

 

Use of Personal Information

We use Personal Information to facilitate the business relationships we have with our customers, including Merchants, to comply with our financial regulatory and other legal obligations, and/or to pursue our legitimate business interests, including, but not limited to, promoting, analyzing, modifying and improving our products, systems and services, analyzing and advertising our products and services, conducting aggregate analysis and developing business intelligence that enable us to operate, protect, make informed decisions, and reporting on the performance of our business. We also use Personal Information to complete payment transactions and to provide payment-related services to you and Merchants. We may use Personal Information to send you marketing communications about our products and services or the products and services of third parties, invite you to participate in our events or surveys, or otherwise communicate with you for marketing purposes, provided that we do so in accordance with the consent requirements that are imposed by applicable law. We may also use Personal Information to provide you with target advertisements for products or services offered by us or third parties, where allowed by applicable law.

 

Disclosure of Personal Information

We do not sell or rent Personal Information to marketers or unaffiliated third parties. We share your Personal Information: (i) in order to provide our Services and for internal administration purposes; (ii) with our service providers that provide services on our behalf, such as identity verification services, Services hosting, information technology services, customer service, payment services and auditing services, to the extent necessary to perform services on our behalf or comply with applicable law; (iii) with our business partners to the extent necessary to provide our Services to you or Merchants; (iv) with third parties as necessary to provide or use the Services; (v) with third parties for legal reasons, including to comply with any valid legal process, governmental request, or applicable law, rule, or regulation, investigate, remedy, or enforce potential violations of terms governing the use of Services, protect the rights, property, and safety of us, our users, or others, or to detect and resolve any fraud or security concerns; (vi) with third parties as part of a merger or acquisition. Your Personal Information may also be one of the transferred assets as part of a merger, acquisition or bankruptcy; (vii) with our business partners, affiliates, and for our affiliates’ internal business purposes or to provide you with a product or service that you have requested; and (viii) as otherwise permitted by law, including the Gramm-Leach-Bliley Act.

 

Information Storage and Security

Your information may be stored and processed in the United States or any other country in which we or our parent, subsidiaries, affiliates, or service providers maintain facilities or otherwise stores information. If you are located in other regions with laws governing data collection and use that may differ from U.S. law, please note that we may transfer information, including personal information, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction. In addition, information collected about you may be stored using cloud-based services. Information stored in the cloud may be maintained by third-party networks in locations in which such third-party networks operate or maintain data storage or processing facilities. We care about the security of your information and employ physical, administrative, and technological safeguards designed to preserve the integrity and security of all information collected through our Services. However, no security system is impenetrable, and we cannot guarantee the security of our systems 100%. In the event that any information under our control is compromised as a result of a breach of security, we will take reasonable steps to investigate the situation and, where appropriate, notify those individuals whose information may have been compromised and take other steps, in accordance with any applicable laws and regulations.

 

Record Retention

We will retain your information for as long as you use our Services, to resolve disputes, establish legal defenses, conduct audits, enforce our agreements, comply with applicable laws or as long as we otherwise deem appropriate. We also maintain your Personal Information as part of our standard backup procedures.

 

Your Rights and Choices

You have choices regarding our use and disclosure of your Personal Information. Depending on your location and subject to applicable law, you may have the following rights with regard to the Personal Information we control about you: (i) the right to request confirmation of whether we processes Personal Information relating to you, and if so, to request a copy of that Personal Information; (ii) the right to request that we rectify or update your Personal Information that is inaccurate, incomplete or outdated; (iii) the right to request that we erase your Personal Information in certain circumstances provided by law; (iv) the right to request that we restrict the use of your Personal Information in certain circumstances; and (v) the right to request that we export to another company, where technically feasible, your Personal Information that we hold in order to provide Services to you. Where the processing of your Personal Information is based on your previously given consent, you have the right to withdraw your consent at any time.

To exercise your rights, you must contact us at support@gounified.com. We will comply with your request to the extent required by applicable law. We will not be able to respond to a request if we no longer hold your Personal Information or we are otherwise not required by law to respond to a request. If you effectuate a transaction with a Merchant using our Services, please directly contact the Merchant for any transaction related questions or requests.

 

Other Rights and Important Information

We do not knowingly collect, maintain, or use personal information from children under 13 years of age, and no part of our Services are directed to children under the age of 13. If you learn that your child has provided us with Personal Information without your consent, please let us know by contacting us at support@gounified.com. If we learn that we have collected any personal information from children under 13, we will use commercially-reasonable efforts to delete such information. If you are a user of the Services and a California resident, California’s “Shine the Light” law (California Civil Code §1798.83) permits you to request and obtain from us once a year, free of charge, information regarding our disclosure of your personal information (if any) to third parties for direct marketing purposes.
